1. INTRODUCTION
1.1. PURPOSE OF POLICY.
ChronoViking, LLC ("us," "we," or "Company") is committed to respecting the privacy rights
of its
customers, visitors, and other users of PolyMatchMaker.com and/or its mobile applications
(the "Site").
We created this Privacy Policy ("Policy") to alert you to what information we collect when
you visit the
site, how this information is used and who has access to it. This Policy is incorporated by
reference
into our Terms of Service.
1.2. AGE RESTRICTION
This Site is targeted to adults 18 years of age and older. This site is neither specifically
nor
generally targeted towards individuals younger than 13 as contemplated by the Children's
Online Privacy
Protection Act of 1998. The discovery of any individual under the age of 18 on the site will
result in
termination of the account of the individual in question and the deletion of all information
related to
said individual. If you become aware of any minor using the site, please contact us
immediately.
1.3. MINOR ERASER LAW PROVISION
This Site is not intended for use by individuals under the age of 18 years of age as
detailed in section
1.2 of this Privacy Policy. Washington law requires websites to provide a mechanism through
which
individuals under age 18 can directly remove or request the removal of content from a
website. Although
the Site is not intended for use by individuals under the age of 18, we have tools available
to
facilitate the removal of data from the Site should we discover a person under 18 is on the
site via our
own investigation, being given notice by a third-party or upon notice received from the
individual in
question. To request said removal, please contact us.
2. INFORMATION COLLECTION PRACTICES
2.1. WHAT BASIC INFORMATION DOES THE COMPANY COLLECT?
In operating the Site, we include a registration process that asks users to provide their
full name,
login name, email address, date of birth, gender, sexual orientation, country, region, city,
a
biographical message, a statement of the type of person(s) sought, and a profile quiz
providing more
detailed information about you (collectively "Personal Information"). If you purchase a
premium
membership, you will be asked to use PayPal.com to make payments and we receive information
from
PayPal.com verifying the payments on an ongoing basis. For the purposes of clarification in
these terms,
"Login Name" shall refer to and include the terms login name, screen name, screen identity
and other
identifiers of you as an individual on the Site.
2.2. WHAT ADDITIONAL INFORMATION DOES COMPANY COLLECT?
AUTOMATIC COLLECTION. Our servers automatically recognize visitors' domain names and
IP
addresses (the number assigned to computers on the Internet). No Personal
Information about you
is revealed in this process. The Site may also gather anonymous "traffic data" that
does not
personally identify you, but that may be helpful for marketing purposes or for
improving the
services we offer.
COOKIES. We use cookies to identify you when you come to the Site and to ascertain
your movements within the Site.
Cookies help us learn which areas of our site are useful and which areas need
improvement. You can choose whether
to accept cookies by changing the settings on your browser. However, if you choose
to disable this function, your
experience at our Web site may be diminished and some features may not work as they
were intended.
BROWSER DO NOT TRACK SIGNALS. You may elect to designate that you do not wish to be
tracked when
using a browser. Certain, but not all, browsers will communicate this intent to
websites via a
"browser signal." At this time, we do not comply with such do not track signals
given that not
all browsers provide the signal and the Site currently does not have the
functionality to
process said signals.
THIRD-PARTY TRACKING OVER SITES AND TIME. We participate in the Amazon.com affiliate
program. In
certain situations, Amazon.com may be able to track you across our website and other
websites
you visit sufficiently to be considered to be gathering personally identifiable
information
about you with said information often being use to tailor ads to your personal
interests and
profile. You can read the collection and advertising policy of Amazon here and opt-out of
the behavioral
tracking efforts of Amazon.com here. We also
make use of Google fonts and analytics programs. We do not provide personal
information about
you directly to Google from our database, however, Google may be able to track you
across
multiple websites and time to create a profile including personally identifiable
information
about you. Google has provided a plugin you can use to logout of such tracking here. You can also review
your profile
and opt-out of being tracked by Google here.
ELECTRONIC COMMUNICATIONS. We may monitor and scan electronic communications
anywhere on the
Site including email messages and electronic chat communications in the ordinary
course of
business as part of our efforts to identify and investigate scams; fraudulent
representations;
actions in violation of the Terms for this Site; membership complaints; new
terminology that can
be used for search engine optimization or marketing purposes; and development of
ideas for
future feature/function needs for software development. This information is not
shared with
advertisers. By agreeing to the Terms and Privacy Policy for the Site, you consent
to such
practices.
3. USE AND SHARING OF INFORMATION
3.1. WHAT DOES COMPANY DO WITH COLLECTED INFORMATION?
PERSONAL INFORMATION. We believe in being transparent when it comes to our practices
regarding
the use of your Personal Information. With this in mind, we use your Personal
Information as
follows:
Advertisers. We do not provide Personal Information to advertisers. We do
provide
aggregate user data for our site to assist advertisers in determining if
they wish to
advertise with us. If you click on any links, banners or other items taking
you to an
advertiser site, please refer to the privacy policy for the advertiser site
to learn the
privacy practices adhered to by their site.
Email Communications. We send you an email communication any time another
member
contacts you. To do so, we may include your Login Name and use your email
address. We
may also send you email communications regarding administrative matters,
site changes or
other topics. When sending said email communications, we access and use your
Login Name
and email address as listed in your member profile. You can logout of such
email
communications on your account page within the site.
Administrators. Site administrators are given access to the personal
information of all
members as necessary to perform a number of internal functions such as
resolving member
disputes, carrying out internal site functions, providing customer service
and other
necessary services.
Internal Member Searches. Members may perform member searches within the
site to
identify other members fitting particular search criteria. We do not share
your Personal
Information with other members conducting said searches, however we use your
Personal
Information internally to process said searches to produce relevant results.
The
Personal Information used in this manner may include your location, age,
date of birth,
gender, orientation, and quiz answers.
Viewable Member Information. When you join our Site, you provide Personal
Information.
Members may view the information of other members. The viewable member
information
includes you Login Name, city, region, country, age, a description provided
by you,
photos, individual narratives and other information. Your true name, email
address,
telephone number and physical address are NOT viewable by other members when
they browse
or search member profiles.
Paid Membership. You have the option of undertaking a paid membership with
the Site.
Payment for said membership is processed solely through PayPal.com. We share
member
identifying information with PayPal.com and it with us so that we may verify
who is a
paying member and who is not. If you wish to STOP PAYMENT for your
membership, you must
do so through PayPal.com. We have no control of the payments you make. All
transactions
through PayPal.com are controlled by its terms of service and privacy
policy.
Newsletters and Editorials. From time-to-time, we may publish newsletters,
editorials or
other communications to members as a group communication. We do not provide
Personal
Information of members in said communications, but we may identify members
by their
Login Name.
Moderators. We use moderators in certain sections of the site. Moderators do
not have
access to Personal Information of members. Moderators may, however, refer
matters to the
site administrators who do have such access as described herein.
Legal Counsel. Should a matter arise requiring a legal opinion, advice or
action, we may
provide our legal counsel with access to the Personal Information of members
involved
directly or indirectly in said disputes.
Copyright/DMCA Disclosure. We comply with the Digital Millennium Copyright
Act in
relation to copyright claims. Should you make a copyright infringement claim
or be
accused of posting copyrighted material, we may choose to release your
Personal
Information to the other party in the dispute. Should the copyright holder
seek a
subpoena pursuant to the "DMCA", we will be forced as a matter of law to
reveal all
Personal Information we have on a member responsible for making the
contested post as a
matter of law.
Tax Professional. We retain a tax professional to prepare our tax returns
and necessary
tax documents. We may provide the tax professional with access to general
information
regarding members as part of a bookkeeping, reconciliation or tax return
preparation
process. This access is restricted to member names, if necessary. No access
is given to
any other member Personal Information.
ANONYMOUS INFORMATION. We use anonymous information to analyze our Site traffic, but
we do not
examine this information for individually identifying information. In addition, we
may use
anonymous IP addresses to help diagnose problems with our server, to administer our
site, or to
display the content according to your preferences. Traffic and transaction
information may also
be shared with business partners and advertisers on an aggregate and anonymous
basis.
USE OF COOKIES. We may use cookies to deliver content specific to your interests, to
save your
password so you don't have to re-enter it each time you visit our site, to highlight
forum
postings that may be of interest to you or for other purposes. Promotions or
advertisements
displayed on our site may contain cookies. We do not have access to or control over
information
collected by outside advertisers on our site.
DISCLOSURE OF PERSONAL INFORMATION. We may disclose Personal Information if required
to do so by
law or in the good-faith belief that such action is necessary to (1) conform to the
edicts of
the law or comply with legal process served on Company or its parent company,
subsidiaries or
affiliates, (2) protect and defend the rights or property of Company or the users of
the Site,
or (3) act under exigent circumstances to protect the safety of the public or users
of the Site.
In so doing, we may disclose your Personal Information to our legal representation
if necessary.
SALE OF INFORMATION. We do not rent, sell, or share your personally identifiable
information to
any third-party advertisers. We may share aggregate data with third parties, but
your individual
data will not be revealed.
In order to accommodate changes in our business, we may sell or buy portions of our
company or
other companies or assets, including the information collected through the Site. If
we sell
part or substantially all of our assets to a third-party, customer information will
be one of
the assets transferred to the acquirer.
ACCESS TO INFORMATION. You may access your information by logging into your account
and
selecting "Edit your profile". This will allow you to edit information in your
profile. To remove
your profile from viewing by other members, please visit the "Delete My Profile"
section of the PMM FAQ when
you login to the Site. Upon deletion, you will not be able to access, use, or renew
the
account.
Should you seek to remove or delete information in your profile or on the Site, we
will save the
files related to it as an automatic function. Should a dispute arise, we may access
these files
pursuant to a court ordered legal action in a matter between private parties, a law
enforcement
action or a legal dispute involving us.
4. SECURITY
The Site has security measures in place such as Secure Socket Layers, firewalls and other
measures to
prevent the loss, misuse, and alteration of the information that we obtain from you, but we
make no
assurances about our ability to prevent any such loss, misuse, to you or to any third-party
arising out
of any such loss, misuse, or alteration. Although we strive to protect your information, it
is important
to understand there is no such thing as total security for a website whether it be ours or
another site.
5. WEBSITE AREAS BEYOND COMPANY'S CONTROL
5.1. PUBLIC FORUMS
The Site may include interactive forums such as message boards and chat rooms. Any
information you
provide in these areas is viewable to other members. Do not provide any information,
personally
identifiable or otherwise, you wish to keep private.
5.2. THIRD-PARTY WEBSITES
The Site contains links to other websites. If you choose to visit other websites, please
understand
those sites maintain their own terms of use, privacy and data retention policies over which
we have no
control. We strongly encourage you to closely read the legal documents of any site you
visit. This
Privacy Policy for this Site does not apply to any third-party sites you might access.
6. CONTACT INFORMATION AND POLICY UPDATES
6.1. CONTACTING US
If you have any questions about this Policy, our practices related to this Site, or if you
would like to
have us remove your information from our database please feel contact us by using the
"Contact Us"
feature on the site.
6.2. UPDATES AND CHANGES
We reserve the right to amend this Policy in light of any changes in privacy law or company
procedures
related to privacy issues on the Site. We will provide you notice of the intended amendment
to this
Policy when you log into your membership account. You may choose to accept or not
accept the
amendment to the privacy policy. To express your acceptance, you will be asked to read the
policy and
"check a box" indicating you agree to the amendment. You are not required to agree to the
amendment and
may discontinue your use of the Site.
7. ACCOUNT CLOSURE & DELETION
7.1. WHAT HAPPENS WHEN YOU DELETE YOUR PROFILE
If you choose to close your PMM account, your member page will generally stop being visible
to others on
our service within 24 hours. We will retain your account data even after you have closed
your account if
reasonably necessary to comply with our legal obligations (including law enforcement
requests), meet
regulatory requirements, resolve disputes, prevent fraud and abuse, enforce our Terms &
Conditions, or
fulfill your request to "unsubscribe" from further messages and notifications from PMM.
Account data
includes the username, email address, biography, IP address, event log, account notes, legal
agreements,
and internal mail.
Information you have shared with others (e.g., through PMM mail and or messaging as well as
PMM poke
messages and poke responses) will remain visible for a period of time to members you have
reached out to after you closed
your account or deleted the information from your own profile or mailbox, and we do not
control data
that other members copied out of our PMM.
